Insurance Bad faith
At the very core of marine insurance is the doctrine of good faith.
Both insured and insurer have a duty of good faith to each other. The duty extends to insurance intermediaries such as brokers and agents.
The insured has a duty to be truthful at the time of submitting information in support of his application for insurance.
On the other hand, an insurer has a duty to act fairly, consistently and reasonably during the underwriting and claims process.
Alan is a ‘bad faith’ expert in both marine and non marine insurance.
He has successfully testified at trial on bad faith practices. He has been retained on a number of occasions to address bad faith practices in his reports.
